Diddy’s Lawyers Ask Judge To Release Him From Jail While Awaiting Sentencing In Latest Motion

Diddy’s lawyers are spinning the legal block again making another bail request to get the Bad Boy boss out of jail while he waits on sentencing.

Early Tuesday morning, his legal team filed a fresh motion asking a New York federal judge to let him out, claiming his charges don’t warrant a jail cell.

“Sean Combs should not be in jail for this conduct,” attorney Marc Agnifilo wrote in the 12-page document. “He may be the only person currently in a United States jail for being any sort of john… and certainly the only person in jail for hiring adult male escorts for himself and his girlfriend, when he did not even have sex with the escort himself.”

Jury Let Him Off the Hook for Sex Trafficking—But He’s Still in Trouble

As we previously reported, Diddy beat the worst of the charges. As previously reported, a Manhattan federal jury found him not guilty on racketeering and sex trafficking charges — crimes that could’ve landed him in prison for life.

But the jury did find him guilty on two violations of the Mann Act — a law that criminalizes transporting people across state lines for prostitution purposes. Each count carries a max sentence of 10 years, but Diddy’s team says the whole situation is being twisted.

They argue what went down was nothing more than a consensual lifestyle choice between adults, labeling it a “swingers” situation involving Diddy and his long-term girlfriend. No coercion. No violence. No trafficking.

In the motion, Diddy’s legal team makes it crystal clear: This wasn’t sex trafficking. This wasn’t abuse. This was a modern adult relationship

The lawyers even cited other similar Mann Act cases where people were not locked up during sentencing when no violence or trafficking was involved. So why is Diddy being treated differently?

Their argument? “This is about optics — not justice.”

They claim Diddy is being made an example of, especially given his celebrity status, and that the law is treating him unfairly because of past allegations that aren’t even part of this conviction.

Cassie’s Name Still Haunting Diddy’s Legal Battles

Although this conviction isn’t tied to Cassie, judges keep bringing her name up when deciding whether to grant bail.

His previous bail motions were already denied — even though he offered his $48 million Star Island mansion in Miami as collateral. Multiple judges ruled against him, pointing to the 2016 assault on Cassie at a Los Angeles hotel and allegations of witness tampering afterward.

And that’s what’s making it hard for Diddy to walk out free — despite the defense team insisting he’s not a threat.

His legal team has promised, “If released on conditions, Sean Combs will not be violent to anyone,” Agnifilo wrote. “As we said in court, this jury gave him his life back, and he will not squander his second chance at life, nor would he do anything to further jeopardize his children not having a father.”

Basically, they’re painting Diddy as a man trying to bounce back — not a menace to society.
