Well, after a chaotic weekend, Donald Trump received some good news this Monday morning. In a major development, a federal judge officially dismissed the case involving classified documents against the former. The charges, which alleged mishandling of sensitive government documents after leaving the White House, have been dropped for Trump and his two co-defendants.
U.S. District Judge Aileen Cannon, in a 93-page order, stated that she has granted Trump’s request to dismiss the indictment. The dismissal was based on the argument that the appointment and funding of special counsel Jack Smith, who brought the charges against the former president, were unlawful.
“The bottom line is this: The Appointments Clause is a critical constitutional restriction stemming from the separation of powers, and it gives to Congress a considered role in determining the propriety of vesting appointment power for inferior officers,” wrote Cannon. “The Special Counsel’s position effectively usurps that important legislative authority, transferring it to a head of Department, and in the process threatening the structural liberty inherent in the separation of powers.”
As we previously reported, the case against Trump involved 40 charges related to his handling of documents marked classified after his time in office. Additionally, he was accused of obstructing the Justice Department’s investigation into the matter. Trump’s aides, Walt Nauta and Carlos de Oliveira, were also charged in connection with an alleged scheme to impede the federal probe. All three individuals pleaded not guilty.
Following the dismissal, Trump took to his newly launched social media platform, Truth Social, to express his reaction. He emphasized the need for unity in the nation, particularly in the aftermath of recent events. Trump stated:
“As we move forward in uniting our nation after the horrific events on Saturday, this dismissal of the Lawless Indictment in Florida should be just the first step, followed quickly by the dismissal of ALL the Witch Hunts — The January 6th Hoax in Washington, D.C., the Manhattan D.A.’s Zombie Case, the New York A.G. Scam, Fake Claims about a woman I never met (a decades-old photo in a line with her then-husband does not count), and the Georgia “Perfect” Phone Call charges. The Democrat Justice Department coordinated ALL of these Political Attacks, which are an Election Interference conspiracy against Joe Biden’s Political Opponent, ME. Let us come together to END all Weaponization of our Justice System, and Make America Great Again!”
This dismissal is definitely an interesting development in the legal battles surrounding the former president. As the case against Trump and his co-defendants comes to an end, he still has a mountain of cases to battle through.
Meanwhile, he’s also still recovering after being shot at over the weekend at his rally in Pennsylvania.
