Although Kroy Biermann recently scored a couple of touchdowns in the bedroom with his estranged wife Kim Zolciak, he still doesn’t want to be part of #TeamMarriedLife as he wants out of his marriage!
The former NFL player has fired back at his estranged wife and is making it real clear there is no hope to save their marriage. As we previously reported, Zolciak recently filed a petition to dismiss their divorce as she claims they’re still having sex! Kim says Kroy’s claim the marriage is “irretrievably broken” is BS because how can it be broken if they’re still going to Pound Town?
Well, in response to that, Kroy says in new legal docs, obtained by TMZ, that although he had sex with Kim it “does not indicate a desire to reconcile” and he “remains steadfast in his desire to divorce…” Well damn!

In her pension she cited two previous Georgia court cases — one from 1978 and one from 1980 and argued “The allegation of an irretrievably broken marriage is demonstrably false if the parties have resumed cohabitation or have reconciled for any period. The very fact of cohabitation or reconciliation shows that some possibility remains that the marriage is viable…the parties are required to once again affirm that the marriage is indeed irretrievably broken by the bringing of a new complaint.”
It continues, “The fact that marital relations between the parties occurred up until and then continued after the filing of the Petition, and after Respondent was personally served with the Petition, demonstrates that the marriage is, or was at some point viable after the filing of the Petition proving that the allegations of the marriage being irretrievably broken are demonstrably false.”
It looks like Kroy is serious about where he stands because he’s also still moving forward with selling their Georgia mansion and moving somewhere else with their kids.

Earlier this month, Kim Zolciak recently took to social media to set the record straight following reports that she had moved out of her and estranged husband Kroy Biermann’s Atlanta home. While doing that she clarified her and the former athlete’s relationship status.
“I’m living here not going anywhere!” Kim wrote over a video of her closet on Sept. 8, per Page Six. “Been working on our marriage and have been living as husband and wife. The lies daily are too much.”
Kory share several kids together. H adopted Zolciak-Biermann’s now-adult children — Brielle, 26, and Ariana, 21. They also share sons Kroy “KJ” Jr., 12, and Kash, 11, and twins Kaia and Kane, 9.
