A Los Angeles man has filed a class action lawsuit against the creators of Texas Pete Hot Sauce for false advertising.

Philip White filed the lawsuit against T.W. Garner Food Co, claiming that its advertising deceived him after purchasing the $3 hot sauce at Ralph’s grocery store in 2021. He alleges that the company was aware of the massive demand for “authentic” Texas hot sauce and “cheated its way to a market-leading position in the $3bn hot-sauce industry at the expense of law-abiding competitors and consumer.” Additionally, he noted that the bottle’s label included the lone star and a cowboy.
“White relied upon the language and images displayed on the front label of the product, and at the time of purchase understood the product to be a Texas product,” the complaint said. Additionally, he was surprised after learning that the hot sauce is manufactured in Winston-Salem, North Carolina.

“In revealing the thought process behind its brand name, (T.W. Garner Food Co.) admits that Texas’s reputation was one they were trying to mimic and capitalise on when creating their brand”
White claims he if he knew that the sauce was made in North Carolina, he would’ve never made the purchase and believes others have gone through the same ordeal. “White relied upon the language and images displayed on the front label of the product, and at the time of purchase understood the product to be a Texas product,” the lawsuit continued.
Social media reacts to the lawsuit, saying the man overreacts but believes he may have a case on his hands.
Although the lawsuit may sound bizarre to some, there is a way White could win the case, as he did say the sauce was advertised to be made in Texas despite the company’s owners being aware that it was made in North Carolina.
Me: Another person suing about something that did no harm to them.
Also me: but why is a Texas hot sauce made in North Carolina? That’s false advertising pic.twitter.com/TnoBjXkn4c— Austen Hawthorne (@0ne_O) October 9, 2022
I’m amused at the responses saying “the lawyer who filed this will be sanctioned.” I defend these suits all the time. That will never happen. Most likely outcome: the lawyer scores a huge settlement, b/c it can cost millions to defend even the silliest false ad class action.

Lawyers have sued Froot Loops for not containing real fruit, and have sued Cap’n Crunch because “crunch berries” aren’t real berries. Those suits were thrown out, but not even those lawyers were sanctioned. I’ve never seen a lawyer sanctioned for filing a silly food class action.
