Ohio Governor Mike DeWine has officially signed a bill that restricts bathroom access for transgender students.
This decision came down hard after the Ohio Senate voted to align with the House, officially passing the legislation on November 13. The bill, originally known as House Bill 183, has now been tucked into Senate Bill 104, which also modifies the College Credit Plus program in the state.
So what’s the deal with Senate Bill 104? It’s a piece of legislation that mandates schools to designate bathrooms, locker rooms, and overnight accommodations based strictly on a student’s “biological sex”—which, for the record, is what’s noted on their birth certificate. What’s even more concerning is that this bill also bans the establishment of any all-gendered restrooms in schools. In just 90 days, this law will hit the ground running.

The ACLU of Ohio has been vocal against this bill, pointing out its “harmful anti-trans” aspects. They argue that this legislation completely disregards the harsh realities that transgender individuals face, especially when it comes to violence and harassment in public restrooms. Jocelyn Rosnick, the ACLU of Ohio’s policy director, emphasizes, “S.B. 104 is a cruel invasion of students’ rights to privacy, which could result in unwarranted governmental disclosures of private, personal information.”
The reaction from the LGBT Community Center of Greater Cleveland was equally fierce. They expressed deep disappointment over Gov. DeWine’s decision, stating, “This legislation undermines the dignity and safety of transgender Ohioans, sending a message that their identities are not valid or deserving of respect.” They highlighted that there’s no real evidence to support the notion that inclusive bathroom policies threaten public safety. Instead, this law is set to push an already marginalized community further into the shadows.
