Donald Trump has been trying to wiggle his way out of some of these legal cases but he’s been unsuccessful with his latest attempt.
This Thursday, a federal judge in New York has denied the former’s request for a new trial in the defamation case brought against him by writer E. Jean Carroll. The judge upheld the jury’s decision to award Carroll $83.3 million in damages.
Judge Lewis Kaplan stated that the damages awarded to Carroll were not solely for emotional distress but were justified given the nature of Trump’s attacks on her, which reached over 100 million people. The judge also noted that Mr. Trump’s actions endangered Carroll’s health and safety, making the damages appropriate. The trial, which lasted five days in February, concluded with Trump being ordered to pay $83.3 million to Carroll for defaming her in 2019 when he denied her allegations of sexual abuse. The damages included $17.3 million in compensatory damages and $65 million in punitive damages.
In a separate trial in May 2023, Trump was found liable for sexually abusing Carroll in the 1990s and defaming her in a 2022 social media post. However, the jury did not find evidence to support Carroll’s claim of rape against Trump.
“Contrary to the defendant’s arguments, Ms. Carroll’s compensatory damages were not awarded solely for her emotional distress; they were not for garden variety harms; and they were not excessive,” Judge Lewis Kaplan wrote.
“Mr. Trump’s malicious and unceasing attacks on Ms. Carroll were disseminated to more than 100 million people,” he added. “They included public threats and personal attacks, and they endangered Ms. Carroll’s health and safety.”
Despite the rulings against him, Trump continues to deny any wrongdoing and insists that he was not familiar with Carroll prior to the legal proceedings.
