Subway Chokehold: Conservative Support For Daniel Penny Surges As He’s Released On Bail In Jordan Neely Killing
As we previously reported earlier this week, Daniel Penny — the 24-year-old former Marine who was seen on video putting 30-year-old Jordan Neely, an NYC subway performer who was homeless, in a 15-minute chokehold on an F train — was set to be charged with second-degree manslaughter as of Thursday (May 11). Meanwhile, Neely’s family argues that Penny should be charged with second-degree murder.
On Thursday evening, the Manhattan District Attorney’s Office announced it would pursue the criminal charge against Penny for the May 1 killing of Neely, who was believed to have been struggling with mental health issues. While he told subway goers that he had no food or drink, he was allegedly perceived to be a threat as he “aggressively” told commuters his situation.
On Friday (May 12), Penny was seen arriving at the 5th Precinct in Lower Manhattan around 8 AM to surrender to police and face his charge. Penny’s lawyer, Thomas Kenniff, spoke out and said, “This morning, Daniel Penny surrendered at the 5th Precinct at the request of the New York County District Attorney’s Office. He did so voluntarily and with the sort of dignity and integrity that is characteristic of his history of service to this grateful nation. The case will now go to court.”
Penny was later taken to his afternoon arraignment, where he waived the right to hear his charges, and was not required to enter in any pleas. It is reported that this is because a grand jury has not yet indicted him.

Also during Penny’s arraignment, his attorneys told the judge that he had been cooperating with police and the District Attorney’s Office, as he has strong ties to New York City, having attended a four-year college in pursuit of a bachelor’s degree in architecture.
His attorneys also claimed that he enlisted in the Marine Corps when he was a teenager, and after spending four years in the corps, and earning several medals and ribbons for good conduct, he was honorably discharged.

Hours later, Penny would then be released on a $100,000 cash bail and was ordered to hand over his passport and remain in the state of New York. He is due back in court on July 17.
Since Penny was charged and released on bail, it is reported that support from Conservatives has surged in his favor. Republicans like Florida Governor Ron DeSantis, Fox News personalities and other conservatives on Twitter are rooting for him, and some are even haling the veteran as a “hero” and “good Samaritan.”

On Friday night (May 12), DeSantis tweeted, “We stand with Good Samaritans like Daniel Penny. Let’s show this Marine … America’s got his back.” Also, Georgia Congresswoman Marjorie Taylor Greene (R) said, “The Marine who stepped in to protect others is a hero.”
A legal-defense fund has even been set up by Penny’s attorneys, on the same crowdfunding site that hosted fundraisers for the defendants in 2021’s Capitol riots on January 6. As of Sunday evening (May 14), the fund has raised over $1.8 million.
