The subway passenger who held Jordan Neely in a chokehold for 15 minutes has released a statement through his attorney.

Daniel Penny’s attorney released a statement days after Jordan Newley’s death sparked outrage across social media after the 30-year-old was held in a chokehold for 15 minutes. “Earlier this week, Daniel Penny,24, was involved in a tragic incident on the NYC Subway, which ended in the death of Jordan Neely. We would first like to express, on behalf of Daniel Penny, our condolences to those close to Mr. Neely,” the statement reads.

 

“Mr. Neely had a documented history of violent and erratic behavior, the apparent result of ongoing and untreated mental illness. When Mr. Neely began aggressively threatening Daniel Penny and the other passengers, Daniel, with the help of others, acted to protect themselves, until help arrived. Daniel never intended to harm Mr.Neely and could not have foreseen his untimely death. For too long, those suffering from mental illness have been treated with indifference.”

The statement concludes: “We hope that out of this awful tragedy will come a new commitment by our elected officials to address the mental health crisis on our streets and subways.” Petty’s statement was released days after people asked for his name since NYPD investigators did not previously identify him. Additionally, Petty was initially taken in to be questioned about the incident but was later released.

An autopsy conducted by the medical examiner determined that Neely’s cause of death was a “compression of the neck” and the manner was ruled as a homicide. The medical examiner also requested additional tests to examine the tissue on his neck. On Wednesday, the Manhattan District Attorney’s Office said they were investigating Neely’s death.

Mayor Eric Adams also released a statement regarding Neely’s death, which received backlash from other political figures such as Alexandra Ocasio-Cortez.

“Any loss of life is tragic. There’s a lot we don’t know about what happened here, so I’m going to refrain from commenting further. However, we know that there were serious mental health issues in play here, which is why our administration has made record investments in providing care to those who need it and getting people off the street and subways and out of dangerous situations. And I need all elected officials and advocacy groups need to join us in prioritizing getting people the care they need and not allowing them to languish.”
