Woman Sues McDonald’s For $13 Million After Accusing Staff Of Serving Coffee Containing Chemicals

A Florida woman filed a $13 million lawsuit against McDonald’s after claiming one of its employees served her a coffee containing chemicals that allegedly caused severe throat and organ damage.

Sherry Head ordered a caramel macchiato at the drive-thru of a McDonald’s restaurant in Dothan, Alabama, in December 2020. According to the suit, she was allegedly told by a staff member that she couldn’t have the coffee because the machine was being cleaned but heard another employee say that the device was ready for use. The employee then served Head her coffee, and the cup came with a lid. After drinking a portion of the beverage, she started experiencing a burning and numbing sensation in her throat.

The suit added that Head removed the lid from the cup and noticed that the liquid was not coffee but a chemical. She returned to the drive-thru line and explained to a manager about the incident, leading the manager to “scream” at the employees, Insider reported.

Head asked the manager for the chemical bottle and asked what else she could do regarding the incident, but the manager refused to give her the bottle. Additionally, the manager refused to call 911 and slammed the drive-thru window. After Head called 911, medical responders asked to see the bottle, but the staff refused.

“As a direct result of drinking the dangerous chemical concoction served to her by McDonald’s, the plaintiff suffered injuries to her mouth, throat, esophagus, stomach, digestive tract, and other internal organs. McDonald’s conduct towards the plaintiff was atrocious and utterly intolerable.”

In a statement to Insider, McDonald’s said they knew about the lawsuit and conducted an internal investigation to understand what happened.  “Immediately upon learning of this concern, we conducted a thorough investigation to understand the facts. We are aware of the complaint filed in the Houston County, Alabama circuit court,” said the restaurant’s owner and operator, Gerry Murphy. The lawsuit also mentioned other incidents involving chemicals in other beverages such as iced tea, hot chocolate, and soda.

“The health and safety of our customers and employees is always a top priority,”

Head is seeking $10 million in punitive damages and $3 million in compensatory damages: and the suit is targeting McDonald’s, the Alabama branch, and the owner-operators.
